Excellent attorney and legal team. Robyn Lesser was recommended to me by an amazing attorney from Altomonte Springs Florida who was working on my Mom’s civil theft case.

Robyn and her amazing team —put a tremendous amount of effort— into my case and got the case dismissed. It takes a time and Robyn’s dedication and expertise as an attorney helped relieve a lot of stress. Feel free to ask questions if you have any regarding this recommendation.

Frequently Asked Questions

  • What kind of attorney handles estate disputes in Florida?

Estate disputes—including will contests, trust disputes, fiduciary misconduct claims, and inheritance litigation—are handled by attorneys who focus on probate and trust litigation.

These matters require knowledge of both Florida probate law and civil litigation procedures.

  • What does a fiduciary litigation attorney do?

A fiduciary litigation attorney represents clients involved in disputes with trustees, executors, or personal representatives who may have violated their legal duties. These cases can involve breach of fiduciary duty, removal actions, asset recovery, accounting disputes, undue influence cases, and other litigation involving estate or trust administration.

  • Do I need a probate attorney if my family is already in a dispute?

Yes. Once disagreements arise, legal deadlines, procedural requirements, and strategic decisions become increasingly important. Speaking with an attorney early can help protect your rights and prevent costly mistakes.

  • Do I need a trust attorney or a probate attorney?

That depends on how whether you are a trustee, a personal representative or a beneficiary and how the assets were held.

If assets are passing through a will and probate estate and you are the nominated personal representative in a formal administration, Florida law requires that you are represented by counsel. You are not required to hire an attorney to administer an estate that qualifies as a summary administration, but the process is arduous and complicated that most beneficiaries or interested persons hire a probate attorney to help navigate the process correctly and in a timely manner.

If assets are held in a trust, the trustee will hire an attorney to aid the trustee in the administration of the trust assets. If there are concerns about how the trust is being managed, a trust litigation attorney is appropriate. Many matters involve both probate and trust issues, and our firm handles both.

  • Can you represent clients outside of Orlando?

Yes. Although our office is located in Orlando, we represent clients throughout Florida and routinely handle matters across the state. Because residents of other states often move to Florida to retire, we are adept at representing the decedent’s fiduciaries or family members who reside in other states.
